<p><span style="font-family: Arial;">To achieve REAL financial reform we need to pass  Ron Paul&#8217;s Free Competition in Currency Act instead. <a href="http://www.downsizedc.org/etp/campaigns/85" target="_blank">Please  send a letter to Congress pushing for both of these outcomes.</a> </span></p>
<p><span style="font-family: Arial;">You may borrow from or copy the following sample  letter for this purpose . . .</span></p>
<p><span style="font-family: Arial;">In addition to supporting the &#8220;Free Competition in  Currency Act&#8221; please vote NO on the big Obama-Dodd-Frank financial  regulation bill, HR 4173. Ron Paul&#8217;s currency bill addresses the root  causes of the financial crisis, while the regulation bill does not.</span></p>
<p><span style="font-family: Arial;">The financial crisis was caused by . . .</span></p>
<p><span style="font-family: Arial;">* The Federal Reserve keeping interest rates  artificially low<br />
* The Federal Reserve inflating the money supply to satisfy Congress&#8217;s  deficit spending<br />
* Government policies encouraging or forcing financial institutions to  issue credit to undeserving people</span></p>
<p><span style="font-family: Arial;">Together, these policies caused the sub-prime  mortgage crisis and the mal-investment of easy money. The result was the  Great Recession.</span></p>
<p><span style="font-family: Arial;">What does the Obama-Dodd-Frank bill do to address  these problems?</span></p>
<p><span style="font-family: Arial;">NOTHING! </span></p>
<p><span style="font-family: Arial;">Instead, it sets up a &#8220;Consumer Protection&#8221; agency  whose regulations will conflict with other regulatory agencies:</span></p>
<p><span style="font-family: Arial;"><span id="more-10121"></span></span><span style="font-family: Arial;">* Congress wants to continue the policy of  pressuring lenders to continue lending to borrowers with bad credit<br />
* And then when those borrowers default, financial institutions will be  blamed for &#8220;predatory lending&#8221;<br />
* And I won&#8217;t be surprised if some of these institutions are bailed out  at the same time that they are being scapegoated</span></p>
<p><span style="font-family: Arial;">Worse, the Obama-Dodd-Frank bill will create  armies of new regulators determined to harass Main Street businesses who  did nothing to cause the crisis! </span></p>
<p><span style="font-family: Arial;">Even the one good aspect of the bill, an audit of  the Federal Reserve, was severely weakened in the conference committee.</span></p>
<p><span style="font-family: Arial;">But the main problem with this bill is that it  increases the power of the very people who helped create the crisis.  Consider these insights . . . <a href="http://www.aei.org/outlook/100968" target="_blank">http://www.aei.org/outlook/100968</a> </span></p>
<p><span style="font-family: Arial;">* Donald L. Kohn, vice chairman of the Federal  Reserve Board: &#8220;Many central bankers and economists, myself included,  were a little complacent coming into the crisis. We thought we knew  enough about the basic structure of markets and the economy. . . . The  reality is that we didn&#8217;t understand the economy as well as we thought  we did. Central bankers, along with other policymakers, . . . failed to  foresee or prevent a financial crisis.&#8221;<br />
* Economist Arnold Kling: &#8220;The regulators made the same cognitive errors  as the regulated.&#8221;</span></p>
<p><span style="font-family: Arial;">Politicians and regulators do not know any more  about the economy than the businesses and consumers they regulate. But  Congress can do much more damage than any business can . . .</span></p>
<p><span style="font-family: Arial;">* You have vast powers to create laws and  regulations that impact the entire economy &#8212; no business or consumer  can do that<br />
* You suffer no personal consequence equal to the vast size of the  mistakes you make, plus . . .<br />
* You have a disturbing tendency to bailout big businesses and special  interest groups to protect them from the consequences of their mistakes </span></p>
<p><span style="font-family: Arial;">At the heart of the problem is the fact that  government is a monopoly. And the solution is for you to restore my  freedom to choose. Ending the Federal Reserve&#8217;s monopoly control over  what I use for money is a good place to start . . .</span></p>
<p><span style="font-family: Arial;">* Americans are essentially forced to use just one  currency unit, the dollar<br />
* The dollar&#8217;s value is NOT determined by the free market, but by the  Federal Reserve Board<br />
* This monopoly control by the Fed causes wild price fluctuations and  mal-investments in a complex economy</span></p>
<p><span style="font-family: Arial;">Ron Paul&#8217;s Free Competition in Currency Act  provides the real financial reform we need. It repeals the legal tender  law and allows other forms of money to compete.</span></p>
<p><span style="font-family: Arial;">* Individuals and businesses could negotiate their  own terms of purchase, using any form of money they mutually agree on<br />
* The open competition will force the Federal Reserve to stop inflating,  thereby ending the booms and busts caused by the Federal Reserve&#8217;s  policies<br />
* Power and choice will be in the hands of the consumer</span></p>
<p><span style="font-family: Arial;">I insist that you oppose the Obama-Dodd-Frank  financial reform bill, HR 4173. Instead, Support the Free Competition in  Currency Act!</span></p>

<p>Many believe that the Federal Reserve controls interest rates.  <em><strong>But what if they do not?</strong></em> Here is a case for readers to decide on.</p>
<p>The Federal Reserve, myself, and many others, have made the claim that the FED controls <em><strong>both</strong></em> the interest rates and supply of dollars and credit.  [For those unfamiliar with the FED, you can learn just about everything you need to know from the links at the bottom of my <a href="http://towneforcongress.com/platform-issues/federal-reserve">Federal Reserve plank</a>, and this article "<a href="http://towneforcongress.com/economy/fractional-reserve-banking-in-pictures-part-12">Fractional Reserve Banking in Pictures</a>."]  Several weeks, I had a conversation with Karl Denninger <a href="http://market-ticker.denninger.net/">from Market Ticker</a> on the gold market, and we also discussed  his theory that while the FED can jawbone and could theoretically move the federal funds rate wherever it wants, it still follows the marketplace.  In other words, <em>its control of interest rates may be all bluster and a false charade</em>.</p>
<p><span id="more-9636"></span></p>
<p>Denninger noticed that not only does the short-term 3-month US Treasury bill interest rate overlay with the federal funds rate as seen below, but it moves lockstep and actually <em>precedes </em>volatility movements up or down in the rate.  The data and graph can be recreated at <a href="http://research.stlouisfed.org/fred2/graph/?id=DTB3">the FED&#8217;s website here</a> by clicking &#8220;Add Data Series&#8221; then downloading the data. and a spreadsheet download of the data <a href="http://www.scribd.com/doc/30698694/Does-the-FED-REALLY-Control-Interest-Rates">is here</a>.</p>

<p>However, the graph is too zoomed out to really see the US Treasury interest rate move preceding the FED funds shift.  The below graph zooms in on the last huge downshift from roughly 5% in late 2007.  Note the US Treasury drop in the green boxed region precedes the FED&#8217;s actions on the federal funds rate.</p>

<p>If Denninger&#8217;s theory is correct, then the FED is simply following the marketplace that it does, in fact, influence, through the &#8220;injection of liquidity,&#8221; which is just fancy-talk for printing up new dollars with Bernanke&#8217;s infamous printing press.  When the FED creates new money, it is at its heart no different than a form of legalized fraud.</p>
<p><img class="alignright" style="margin: 10px;" src="http://towneforcongress.com/uploads/image/jt-logo-rwb-2-28-10%2817%29.gif" alt="" hspace="10" vspace="10" width="136" height="136" align="right" />A criminal counterfeiter able to create perfect fakes of $100 bills &#8211; or electrons in a bank account &#8211; depresses the natural rate of interest artificially by placing the bills into circulation, which is the exact same result as when the FED does it by creating new dollars.</p>
<p>So is the FED&#8217;s blustering and jawboning about its &#8220;control&#8221; of interest rates simply be hot air?  Does it just print the new money and then monitor the short-term US Treasury interest rates?  If so, then the flat-lining at near-zero interest rates for over a year now is even more of a pressing concern as the ship may be sailing without a rudder!</p>
<p>While I won&#8217;t be so rash as to jump to conclusions, I thought I would instead ask the reader if the above theory makes sense.  Of course, in the future if the US Treasury rate increases first and then the FED follows suit, this will be further evidence of Denninger&#8217;s theory though at this unique moment in history with interest set at near-zero, who knows what will happen.</p>

He then gets to ask Ben Bernanke a few questions on interest rate manipulation. Unsurprisingly, Bernanke claims the problems were due to not enough regulation rather than admit that regulation was the cause of the problems.</p>

			<content:encoded><![CDATA[<p>In Barack Obama&#8217;s latest health care plan is a proposal to give the Health and Human Services secretary the power to block price increases in premiums by health insurers. That power, on its face, would be subjective and political. However, it would complete the take-over of American companies by this increasingly relentless socialist administration.</p>
<p>Look at the facts, these days government dictates how to make a product, the government dictates what to put in a product, the government dictates shipping methodology if the U.S. Postal Service is used, the government dictates working conditions with OSHA, the government dictates minimum pay for employees and who to hire with EEOC laws, the government dictates salaries and bonuses for management in some industries, and, at the end of the day, for its efforts, the government will be on hand to collect its fair share of the company&#8217;s profit through taxation if a company is fortunate enough to make a profit on its transactions.</p>
<p>Now the government wants to dictate to companies what they will charge for their products. </p>
<p>What decision making is left for a company under this administration? Helping pick the color of tablecloths in the company mess hall?</p>
<p>This proposal will be the final nail in the de facto take-over of American business. And it neatly avoids the messiness and expense of actually having to buy or run companies ala General Motors or AIG. Free companies! What socialist politician wouldn&#8217;t be giddy with excitement over the prospect?</p>
<p>You just gotta admire that crazy Capitalist Socialism.</p>

<p><span style="font-family: Arial;">* T.A.R.P. stands for Toxic Asset Relief Program<br />
* The T.A.R.P. was supposed to spend $700 billion buying so-called toxic assets from institutions that were supposedly too big to fail, but . . .<br />
* After Congress said yes to this proposal the Treasury Department instead used the funds to buy stock in major banks<br />
* In other words, The Toxic Asset Relief Program ended up having nothing to do with toxic assets</span></p>
<p><span style="font-family: Arial;">It get&#8217;s worse. According to <a href="http://en.wikipedia.org/wiki/T.A.R.P." target="_blank">Wikipedia</a> . . . .</span></p>
<blockquote style="margin-right: 0px;" dir="ltr"><p><span style="font-family: Arial;">&#8220;On February 5, 2009, Elizabeth Warren, chairperson of the Congressional Oversight Panel, told the Senate Banking Committee that during 2008, the federal government paid $254 billion for assets that were worth only $176 billion.&#8221;</span></p></blockquote>
<p><span style="font-family: Arial;">And even worse . . .</span></p>
<blockquote style="margin-right: 0px;" dir="ltr"><p><span style="font-family: Arial;">&#8220;During 2008, the companies that received bailout money had spent $114 million on lobbying and campaign contributions. These companies received $295 billion in bailout money.&#8221; </span></p></blockquote>
<p><span style="font-family: Arial;">Thus, our quote of the day. Spending $114 million on lobbying to gain $295 billion dollars from the taxpayers is a hell of a deal. Many thoughts flow from this . . .</span></p>
<p><span style="font-family: Arial;">* Those who told us that strong campaign finance laws would curtail corruption were wrong<br />
* Those who tell us we need Big Government to control evil corporations overlook the fact that big corporations want big government, because they benefit from it, and largely control it<br />
* The same kind of lobbying and corporate control is <a href="http://reason.com/blog/show/135193.html" target="_blank">behind the scheme for increased government involvement in health care</a><br />
* And the $800 billion stimulus bill was another heaping helping of corporate welfare too</span></p>
<p><span style="font-family: Arial;">Sadly, this isn&#8217;t a new development. President Obama and the Democratic Congress are just continuing the policies of President Bush and the Republican Congress . . . </span></p>
<p><span style="font-family: Arial;">* Go back and scratch beneath the surface of Bush&#8217;s prescription drug program and you&#8217;ll find that it <a href="http://www.cbsnews.com/stories/2007/03/29/60minutes/main2625305.shtml" target="_blank">was mostly a corporate welfare scheme for Big Pharma.</a><br />
* In addition, T.A.R.P. was passed under Bush and the Republican Congress. </span></p>
<p><span style="font-family: Arial;">As long as partisan loyalists continue to believe that their particular political party, and their particular political savior (be it Obama, Bush, whoever) is somehow different, we&#8217;ll continue to be victims of the same insanity. And at some point we might as well change the country&#8217;s name to . . .</span></p>

<hr /><span style="font-family: Arial;">Some politicians want to mandate that employers provide health insurance for their workers, and/or that individuals must acquire such insurance, much as we&#8217;re all required to have car insurance. This is supposed to achieve universal coverage while also reducing costs. But&#8230;</span></p>
<p><span style="font-family: Arial;">Massachusetts politicians have already run this experiment, with bad results. </span></p>

* This compares to an average nationwide increase of only 5.7% over the same period<br />
* Annual health insurance costs for a family in Massachusetts average about $4,000 more than the national rate<br />
* Health care spending has also increased in Massachusetts by 23% since the coverage mandate was enacted</span></p>
<p><span style="font-family: Arial;">We already know the results of the mandate idea. Congress MUST NOT inflict this mistaken idea on the rest of us.   <span id="more-6009"></span></span><span style="font-family: Arial;">We also know what the results will be if DownsizeDC.org keeps growing&#8230;</span></p>

Yesterday it returned in stellar form with guests Ron Paul, Daniel Hannan, Lew Rockwell, Tom Woods, Peter Schiff, Shelly Roche, and Tom Palmer  (<a href="http://cato.org/">CATO</a>) joining Judge Napolitano.</p>
<p>Ron Paul and Daniel Hannan united in a one two punch fighting for liberty. They spoke about nullification, secession, and then compared Europe and America on the road to socialism. Another topic that they and the other guests discussed was protectionism. Peter Schiff seems to believe the U.S. need not worry too much about protectionism. Tom Palmer disagrees. Woods and Rockwell delve into the prospects for liberty in our lifetime.</p>

			<content:encoded><![CDATA[<p>Yesterday in Congress, sixty-five new bills were introduced.  Due to recent controversy, and for those who start reading this series of articles in the middle, I will include the following boilerplate information in every article.</p>
<p>When taking a look at the list below, keep in mind that the U.S. Constitution, which <em>created</em> our Federal Government, clearly enumerated 18 specific functions that it is given.  For all other things, the 9th and 10th amendment make it clear that the individual states have the power.  Note that it states in the Constitution that it is the Supreme Law of the Land, which can be usurped by no other.  This means that all opinions to the contrary made by the Supreme Court are technically invalid.  Throughout the past couple of hundred hears the Supreme Court has rule one way or another on some “interpretation” of the Constitution, but in fact no interpretation is necessary, as the intention of the founding fathers are quite clear.  For example, if the “general welfare” clause or the “interstate commerce” clause was intended to be used as a catch-all for any arbitrary piece of legislation, then the 10th amendments which reads:</p>
<blockquote><p><em>The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.</em></p></blockquote>
<p>would be completely meaningless.  So simple logic, in addition to the writings of Madison and other founding fathers, dictates the notion that the Federal Government was set up to have <em>very</em> little power, and that these United States are intended to be a loose federation of sovereign states.</p>
<p>Only due to politician’s greed and overwhelming desire for power does the Constitution get relegated to the trash heap.</p>
<p>So, despite the  noble intentions of many of these bills, it doesn’t mean they are legal.</p>
<p>Of the bills introduced yesterday, these are ones that are clearly <em>not</em> legitimate functions of the Federal Government:</p>
<ul>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-759" target="_blank">S-759</a> &#8211; A bill to amend the Transportation Equity Act for the 21st Century to reauthorize a provision relating to additional contract authority for States with Indian reservations.</li>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-760" target="_blank">S-760</a> &#8211; A bill to designate the Liberty Memorial at the National World War I Museum in Kansas City, Missouri, as the &#8220;National World War I Memorial&#8221;.</li>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-761" target="_blank">S-761</a> &#8211; A bill to establish the World War I Centennial Commission to ensure a suitable observance of the centennial of World War I, and for other purposes.</li>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-762" target="_blank">S-762</a> &#8211; A bill to promote fire safe communities and for other purposes.</li>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-763" target="_blank">S-763</a> &#8211; A bill to amend the Robert T. Stafford Disaster Relief and Emergency Assistance Act, to authorize temporary mortgage and rental payments.</li>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-764" target="_blank">S-764</a> &#8211; A bill to amend the Robert T. Stafford Disaster Relief and Emergency Assistance Act, to increase the maximum amount of assistance to individuals and households.</li>
<li><a href="http://www.govtrack.us/congress/bill.xpd?bill=s111-769" target="_blank">S-769</a> &#8211; A bill to amend title XVIII of the Social Security Act to improve access to, and increase utilization of, bone mass measurement benefits under the Medicare part B program.</li>
