This law is also killing the motorcyle industry. All atvs and motorcycles made for kids have been pulled off the market. Most of the bike dealers are hurting from the financial crisis and now this.

I think that you, Mr Babka, should be invoking the Fifth Amendment alongside that oh so ehtical businessman who played peanuts with people's lives--and he was able to fox the so-called market forces that would have, supposedly, in your utopian idea of the market, outed him and his poison.
And, as usual, you prsent the false choice of security vs liberty--we can and must have both. No one has the right to total liberty of press, speech, religion, or anything else, by which I mean the unfettered ability to libel and slander anyone they choose, as an example of such total liberty. And no one has the right to manufacture or market anything they choose over and against the laws that the people have made for their security and happiness--these words should ring a bell of memory with you as they are straight out of the Federalist and the Declaration.
But, Mr Babka, I suspect that you are really for the antics of that posion penut manufacturer--I mean, hey, he's just a businessman engaged in business? Right? Sure, and the world is flat as well.

I don't think we need new laws on the books. This is clearly fraud and false advertising. These companies advertised safe toys for children, and were instead selling dangerous toys.

The market will react properly over time, where "Made in China" will start being a curse.
